Ashton.rent - Comprehensive Terms of Service

Effective Date: April 11, 2025 

Legal Structure & Governing Law 

This Agreement is governed by the laws of the State of Tennessee and applicable federal law, including the Federal Arbitration Act (9 U.S.C. §§ 1–16). Ashton.rent LLC manages vehicle rentals on behalf of its parent company, 10 S. Holdings LLC, which retains legal ownership of all vehicles unless otherwise stated. 

Eligibility Requirements 

  • Be at least 25 years of age at the time of rental 
  • Possess a valid and unexpired U.S. driver’s license 
  • Complete a driver screening process (no credit check required) 
  • Provide accurate and truthful information at all times 
  • Have no history of reckless driving, DUI/DWI, or recent license suspensions 
  • Obtain written approval for any out-of-state travel prior to departure 

Rental Terms: Duration & Renewals 

All rentals require a minimum of three (3) days and are limited to a maximum of fourteen (14) days per agreement. To continue use, the rental must be formally renewed every 14 days. Renewals are subject to review, approval, and payment of outstanding balances. Failure to renew may result in overdue classification, fees, and repossession. 

Security Deposit 

Ashton.rent is a cash-based business. No security deposit is collected for rentals paid in cash. However, a $150 deposit is required when payment is made using a credit card, debit card, or digital method. This deposit may be used to cover unpaid charges, damages, or violations. 

Fee Structure & Billing 

  • Rental Rate: Daily or weekly as agreed 
  • Fuel: Charged at market rate ×2 if not returned full 
  • Cleaning: $50–$250 depending on return condition 
  • Late Return: $20/hour, not to exceed daily rate 
  • Abandonment Fee: $150 + $5 per mile from drop-off location 
  • Admin Fees: $50 per ticket, toll, or violation 
  • Repossession: Recovery, towing, labor, and documentation fees 

Vehicle Use Policies & Prohibitions 

  • Unauthorized drivers not approved by Ashton.rent 
  • Driving under the influence of drugs or alcohol 
  • Off-road use, racing, or illegal transport 
  • Disabling GPS or tampering with vehicle systems 
  • Carrying more passengers than seat belts 
  • Leaving the vehicle unattended with keys inside 
  • Delivery use is permitted with prior written authorization 

Insurance & Liability (T.C.A. § 55-12-102) 

  • Renters must carry valid personal auto insurance. 
  • Ashton.rent may offer state-minimum secondary coverage, which becomes void if: 
      – This agreement is violated 
      – An accident is unreported 
      – The vehicle is driven recklessly or unlawfully 

Damage Waiver (Optional) 

A damage waiver is optional and offered at the time of rental. It is not insurance and does not cover theft, off-road damage, tire issues, lost keys, or any damage from negligence or contract violation. 

Accidents & Incident Reporting 

You must notify Ashton.rent and law enforcement immediately following an accident or incident. A full report must be submitted within 24 hours, including photos and witness details. 

GPS Monitoring & Telematics 

Vehicles are equipped with GPS tracking and diagnostics. Disabling or tampering with these systems is strictly prohibited and may result in repossession and legal action. 

Repossession Rights 

  • Rental has expired 
  • Payment fails 
  • The vehicle is abandoned or misused 
  • Any terms of this agreement are violated 

Fraud & Misrepresentation 

Providing false ID, using stolen payment information, or impersonating another individual is grounds for immediate contract termination and will be reported to law enforcement. 

Third-Party Liability Waiver 

  • Passenger or pedestrian injuries 
  • Damage to third-party property 
  • Any legal or financial claims due to your use of the vehicle 

Personal Property 

We are not responsible for personal items left in the vehicle. Please check thoroughly before returning the car. 

Refund & Cancellation Policy 

  • Cancel ≥ 24 hours before pickup: Full refund 
  • Cancel < 24 hours or no-show: No refund 
  • Early returns: No guaranteed refund 
  • Deposits may be withheld for damage or unpaid fees 

Force Majeure 

We are not liable for failure to perform obligations due to events beyond our control, including natural disasters, civil unrest, pandemics, or power failures. 

Dispute Resolution & Arbitration 

All disputes must be resolved via binding arbitration in Shelby County, TN. No jury trials or class actions are permitted. Arbitrator decisions are final and enforceable. 

BRAVE Amendment Acknowledgment 

You confirm you understand, accept, and voluntarily agree to all terms. You assume full financial and legal responsibility for your rental. 

Severability 

If any part of this Agreement is ruled invalid, the remainder shall remain in full effect. 

Ownership Disclaimer – Legal Separation 

10 S. Holdings LLC is the legal owner of the vehicles but is not involved in rental operations, customer interactions, or service management. All rentals, communications, payments, agreements, and liabilities are exclusively handled by Ashton.rent LLC. As such, 10 S. Holdings LLC shall not be liable for any accidents, damages, legal claims, or losses resulting from vehicle use. 

Entire Agreement & Acceptance 

By using our services, you agree that Ashton.rent LLC is the sole operator responsible for the rental, and you release any affiliated entities, including 10 S. Holdings LLC, from liability associated with the rental, use, or condition of the vehicle. 

Deposit Policy Clarification 

Ashton.rent requires a $150 security deposit for all rentals, regardless of payment method. 
– For cash payments, the deposit is collected in person at the time of vehicle pickup. 
– For credit card, debit card, or digital payments, the deposit is placed on hold in advance as a pre-authorization. 
 
The deposit may be applied to any unpaid rental charges, late fees, damage, or violations of this Agreement.
